Miley & Miley LLP supports Bargaintown in vacating property

Miley & Miley LLP acted on behalf of Bargainprop Ventures, owners of the Bargaintown furniture chain, in securing a High Court injunction requiring the Defendants to vacate Bargainprop’s premises.

Bargainprop, was already represented by us acquiring the premises in 2021 from a receiver appointed by Mars Capital Finance Ireland DAC, following a period in receivership since 2016.

Despite repeated requests, the defendants refused to vacate the premises and allegedly created an unlawful leasehold interest. Legal counsel for Bargainprop described the defendants’ correspondence as “extraordinary” and “absurd,” citing unsubstantiated claims of ownership and unusual documentation.

The property, in receivership since 2016, was originally purchased by the defendants in 1999. A previous court order had already required them to surrender possession. Bargainprop now intends to develop the site for commercial use.

The court found no valid explanation for the defendants’ claims and confirmed they were properly notified of the proceedings.
