Miley & Miley LLP is very pleased to announce the firm’s recent success in applying for a Decision-Making Representative (DMR) Financial Order under the Assisted Decision-Making (Capacity) Act 2015, marking a significant achievement in supporting vulnerable individuals with complex financial decision-making needs.
The Act introduced a modern, rights-based framework to replace much of Ireland’s former wardship system. Central to the legislation is a tiered approach to decision-making supports designed to respect autonomy while safeguarding individuals who may lack capacity. Within this framework, DMR Orders are the most interventionist mechanism and are granted only as a measure of last resort where lesser supports are deemed insufficient.
The DMR Order obtained enabled the newly appointed DMR to make decisions on behalf of the relevant person in terms of substantial financial transactions. The Order also provides authority for the DMR to actively manage and reinvest the individual’s financial assets, ensuring that their resources are handled effectively and in their best interests. This outcome provides vital protection while enabling structured financial stewardship under the safeguards established by the 2015 Act.
