Our Litigation Team has achieved another two significant defence settlements during this week on behalf of separate retail clients, both arising from a slip‑and‑fall incident in the retail sector.

In the first matter, the claim was brought by an employee who alleged substantial loss of earnings due to a lower limb injury, amounting to a six‑figure sum. Following detailed medical and liability investigations post and pre accident by our team, we successfully negotiated a settlement within the Circuit Court jurisdiction (maximum jurisdiction of €60,000.00 for P.I Claims) which amounted to 10% of the original claim, delivering a cost‑effective and strategic outcome for the client.

In a second, unrelated case, the team obtained a further favourable defence settlement on 11 March 2026 on behalf of our commercial client in respect of again a High Court claim arising from a customer slip and fall in a retail premises. The Miley & Miley litigation team carried out in-depth investigations, including a detailed review of the available CCTV footage, which enabled us to advance the position that the Plaintiff’s account of the incident was not accurate. Based on the evidence and investigations undertaken, liability remained fully disputed throughout.

Notwithstanding this position, our team successfully negotiated a settlement within the District Court jurisdiction (maximum jurisdiction of €15,000.00) in circumstances where the proceedings had originally been issued in the High Court by the Plaintiff’s solicitors. This outcome being a fraction of the original sum claimed, provided certainty and represented an excellent commercial result for our client.
