Miley & Miley LLP defended Sports Direct

A Claimant has lost her age discrimination case against Sports Direct Ireland, following an incident where a shop’s security guard asked her to leave one of the retailer’s stores. The Workplace Relations Commission (WRC) ruled that it could not uphold the claim, as the Equal Status Act does not allow age discrimination complaints from individuals under 18.

The Claimant, who was represented by her mother at the hearing argued her daughter was upset and humiliated after being told to leave the store while trying to buy football boots with a €50 note in hand. The mother claimed the incident was poorly handled and amounted to victimisation.

Sports Direct was represented by Ursula Cullen who denied any discrimination took place and challenged the WRC’s authority to hear the case, citing legal protections do not extend to age-related claims by minors under 18.

The WRC accepted the Respondent’s argument that the legislation did not attend to minors in the context of the case.  On that basis, the claim was dismissed and we were successful in our defence.
